These Terms and Conditions (“Terms”) govern your use of the website at premierflooringdesign.com (the “Site”) and the text messaging program operated by Premier Flooring & Design LLC, doing business as Premier Flooring & Design (“Premier Flooring & Design,” “we,” “us,” or “our”). By using the Site, submitting a request through the Site, or opting in to receive our text messages, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site or opt in to text messages.

You may use the Site to learn about our flooring products and services, request a consultation or estimate, and contact us about a project. You agree to use the Site only for lawful purposes, to provide accurate information when you submit a form or request, and not to misuse the Site, interfere with its operation, or attempt to access areas of the Site or our systems that are not intended for public use. Site content, including product descriptions, colors, and photos, is provided for general information. Actual product appearance, availability, and specifications may vary.

Information on the Site, including any pricing examples, promotions, or online estimate tools, is an invitation to request a quote and is not a binding offer or final price. Final pricing, materials, timelines, and scope of work are confirmed only after measurement and review of your project and are set out in a written estimate, proposal, or agreement signed or accepted by you and by us. Installation and service work is subject to scheduling, product availability, site conditions, and the terms in your project agreement, including any warranty terms stated there. If there is a conflict between these Terms and your signed project agreement, your project agreement controls for that project.

Premier Flooring & Design offers a text messaging program for customers and prospective customers who opt in. By opting in, you agree to receive text messages from Premier Flooring & Design at the mobile number you provide, as described below.

You may opt in in any of these ways:

• Website form: submitting your mobile phone number through the request or contact form on premierflooringdesign.com and checking the SMS consent checkbox. That checkbox is unchecked by default; we will not treat a form submission alone, without the checkbox, as consent to marketing texts.
• Verbal opt-in: giving us verbal permission in our showroom or by phone to send you text messages at the number you provide.
• Texting us first: sending a text message to our business number to start a conversation with us.

By opting in, you confirm that the number you provide is yours (or that you are authorized to consent for that number) and you agree to notify us if your number changes or is transferred. Consent to receive text messages is not a condition of purchase or of receiving any product or service from us. In particular, consent to occasional marketing or promotional texts is separate and optional: you may receive customer and project messages without agreeing to marketing messages, and you may decline or withdraw marketing consent at any time by replying STOP, without affecting your project or service.

The Site and its contents, including text, logos, photos, graphics, and design, are owned by Premier Flooring & Design or our licensors and are protected by applicable intellectual property laws. You may view and print Site pages for your personal, non-commercial use in connection with considering or managing your project with us. You may not copy, modify, distribute, or use our name, logo, or Site content for commercial purposes without our prior written permission. Manufacturer and supplier names and trademarks shown on the Site belong to their respective owners.

To the fullest extent permitted by law, the Site is provided “as is” without warranties of any kind, express or implied, including as to accuracy, completeness, or availability. To the fullest extent permitted by law, Premier Flooring & Design will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Site or the text messaging program. Nothing in these Terms limits liability that cannot be limited under applicable law, or any warranty or obligation expressly stated in your signed project agreement with us.

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. Any dispute arising under these Terms or relating to the Site that is not resolved informally will be brought in the state or federal courts located in North Carolina, unless your signed project agreement provides otherwise.

We may update these Terms from time to time. The updated version will be posted on this page with a new “Last updated” date and will apply from that date. Continued use of the Site or continued participation in the text messaging program after an update means you accept the updated Terms.
